The need to improve anti-corruption compliance has never been greater. Increased enforcement from the DoJ and the SEC coupled with harsher penalities and bigger fines should encourage companies to act now and to act quickly.

However, a recent Thomson Reuters survey revealed 54% of executives admitting that no board level responsibility had been allocated for compliance oversight. This shows that, despite the high profile prosecutions and the increase in the size of penalties issued under the US Foreign Corrupt Practices Act (FCPA), many organisations are yet to address the most frequent and common deficiencies in their anti-corruption programmes in a concerted way.

The most common shortcomings include a lack of consistent due diligence and insufficient monitoring of third parties, who often represent the greatest source of corruption risk to a company. In addition organisations are failing to manage the increased corruption risk in major emerging markets.

Given the significant provisions of the new UK Bribery Act (UKBA) and the need for strict compliance with the FCPA, organisations should urgently re-evaluate their anti-corruption compliance programmes.
